DRAFT — not yet in force. Must be reviewed by a qualified solicitor (and, for markets outside the UK, by local counsel) before launch or before taking payment. Last updated: not yet published.
1. About these terms
These terms are a contract between you and
TowerTalk Ltd (“we”, “us”), a company registered in England and Wales (company number 17318142), trading as “TowerTalk”. Our registered office is
Tennyson House, Cambridge Business Park, Cowley Road, Cambridge, CB4 0WZ, United Kingdom. TowerTalk Ltd is not currently VAT-registered. For legal notices, contact us at that address or info@towertalk.co.uk. By creating an account, subscribing, or otherwise using TowerTalk you agree to these terms and to our
Privacy Policy. If you don’t agree, don’t use the service.
2. The service
TowerTalk is a training aid for aviation radio telephony (RT), including UK FRTOL practice and other standards (ICAO, US/FAA). It is not an official source, is not approved or endorsed by the CAA, ICAO, the FAA or any regulator, and must never be used for real flight operations. Always defer to CAP 413, the relevant official publications for your licence and country, and live ATC instructions. Frequencies, runways and procedures shown are indicative for practice only. We don’t guarantee any particular result, exam pass or outcome, or that the service will be uninterrupted or error-free.
3. Who can use it (eligibility)
You must be at least 16 to hold your own account. Under-16s may only use TowerTalk through a school or instructor account where the school has the necessary consent and supervises that use. You must provide accurate registration details and keep them up to date.
4. Your account
You’re responsible for your account and for keeping your login secure. Don’t share your account or let others use it. Tell us promptly if you suspect unauthorised access. You can close your account at any time from your settings.
5. Subscriptions, billing & renewals
Paid plans are billed through Stripe at the prices shown at checkout, in GBP. Prices are the total amount payable — TowerTalk is not currently VAT-registered, so no VAT is added. Subscriptions renew automatically each period until cancelled. We’ll give reasonable advance notice of any price change, which takes effect at your next renewal; you can cancel before then.
6. Live rooms & gifts
Live multiplayer rooms are included with a paid plan and are subject to fair use. Promotional credits and gifted months have no cash value, may expire, and can’t be exchanged. Gift codes may be redeemed once, by one recipient.
7. Cancellation & cooling-off
If you’re a consumer in the UK or EU/EEA you normally have 14 days to cancel a purchase. Because TowerTalk is digital content/services supplied immediately, by starting to use a paid feature within that period you ask us to begin straight away and acknowledge you lose the right to cancel for anything already supplied or consumed. You can still cancel future renewals at any time and keep access until the end of the paid period.
Consumers elsewhere may have similar or additional cancellation rights under local law, which we honour where they apply.
8. Refunds
If something’s wrong, contact us within 14 days of purchase and we’ll consider a refund in line with your statutory rights. Consumed voice credits and used services may not be refundable. Nothing here removes non-excludable consumer rights you have in your country.
9. Schools, instructors & students
If you use TowerTalk as a school or instructor to manage students: you confirm you have the authority and any consents needed to add those students and any student data; you’re responsible for your students’ use and for safeguarding; and you must only upload content you’re entitled to use. You act as the controller of student data you bring to the platform, and we process it on your instructions (see the Privacy Policy).
10. Content you add
You keep ownership of content you add (custom airfields, aircraft, scenarios, uploaded exercise material, messages). You grant us a licence to host and process it to provide the service. You confirm you have the rights to it and that it isn’t unlawful or infringing. Do not upload official documents you aren’t licensed to redistribute (for example CAP 413, which is Crown copyright, or ICAO documents). We may remove content that breaches these terms.
11. Our intellectual property
TowerTalk’s software, design, original training material and brand are owned by us or our licensors. You may use them only to use the service as intended. Don’t copy, resell, scrape or create derivative products from them without our written permission.
12. AI-generated content
Feedback, grading, scenarios, scripts, voice and other AI output may contain errors. Treat it as practice, not authoritative instruction, and verify anything important against official sources.
13. Acceptable use
Don’t misuse the service: no unlawful use, no attempts to break, overload, reverse-engineer or gain unauthorised access, no scraping or automated bulk use without permission, and nothing that harasses others or infringes their rights. We may suspend or close accounts that do.
14. Third-party services
We rely on third parties including Stripe (payments), Supabase (accounts/data), OpenAI (AI processing) and our host. The store may link to third-party retailers and exam centres; purchases and bookings there are governed by their own terms, and some links may be affiliate links. We’re not responsible for third-party sites or services.
15. API access
Any programmatic/API access to TowerTalk’s AI requires our prior permission and may be subject to separate terms, usage limits and fees. Don’t access the service by API without authorisation.
16. Availability & changes to the service
We aim to keep TowerTalk available but don’t guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw features, giving notice where reasonable.
17. Suspension & termination
You can stop using TowerTalk and close your account at any time. We may suspend or end your access if you breach these terms or where we must for legal or security reasons. On termination your right to use the service ends; some provisions (e.g. liability, IP) survive.
18. Liability
Nothing in these terms limits liability that can’t be limited by law (such as for death or personal injury caused by our negligence, or fraud), or your non-excludable consumer rights.
Otherwise, TowerTalk is provided “as is”, and to the extent permitted by law we’re not liable for indirect or consequential loss, loss of profits, or any loss arising from reliance on the service for real-world flying. Because TowerTalk is training only, you must not rely on it for operational decisions.
Subject to the first paragraph above, our total liability to you for all claims connected with TowerTalk is limited to the greater of £100 or the total amount you paid us in the 12 months before the event giving rise to the claim.
19. Indemnity (business & school users)
If you use TowerTalk for business, school or instructor purposes, you agree to cover losses we reasonably incur from your breach of these terms, your content, or your students’ use.
20. Changes to these terms
We may update these terms. We’ll post the new version with an updated date and, for material changes, give reasonable notice. Continuing to use TowerTalk after changes take effect means you accept them.
21. Governing law & where you can bring claims
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you’re a consumer living elsewhere, you keep the protection of any mandatory laws of your country of residence, and you may be able to bring proceedings in your local courts.
22. Contact & complaints
Questions or complaints: [support email]. EU/EEA consumers can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
